Since 2005, Robert V. Glaser has been involved in numerous lawsuits relating to the investments made by the MapleWood Funds. 20 lawsuits were filed that related primarily to an investment made in 2000 by the MapleWood Funds in a company called AMC Computer. Of these 20 lawsuits, the vast majority, 18 lawsuits to be exact, were initiated by one of the MapleWood Funds’ investors, Casita, L.P. (“Casita”), and its affiliated investment entity, Eugenia VI Venture Holdings, Ltd. (“Eugenia”). 2 lawsuits were filed by other parties involved with AMC Computer.


18 Lawsuits Have Been Filed by Eugenia/Casita

Despite all the litigation that has been filed by Casita and/or Eugenia, neither Casita nor Eugenia has ever prevailed in any of the lawsuits against Mr. Glaser and has ever obtained a judgment against Mr. Glaser.

The following is a summary of litigation that has been filed by Casita and/or Eugenia relating to the investments made by the MapleWood Funds:

6 Lawsuits Filed by Eugenia/Casita have been won by Mr. Glaser and related defendants on Summary Judgment in Federal Court.

In 2005 Eugenia/Casita filed a total of 6 separate lawsuits against Robert Glaser, MapleWood and its affiliates and employees and other people associated with AMC Computer. These lawsuits are listed below this explanation.

Mr. Glaser and all other persons and entities sued by Eugenia in all 6 of these lawsuits were found NOT LIABLE for any of the alleged wrongdoing of which they had been accused by Eugenia. Specifically, after a review of all evidence (including thousands of pages of documents), all claims asserted by Eugenia were dismissed by Judge Deborah Batts, United States District Court Judge for the Southern District of New York, when Judge Batts entered summary judgment in favor of Mr. Glaser and all other MapleWood-associated defendants and against Eugenia.

The order granting summary judgment in favor of Mr. Glaser and all against Eugenia was appealed by Eugenia 3 separate times and they lost all 3 appeals. A three-judge panel of the United States Second Circuit Court of Appeals affirmed the summary judgment and dismissal rulings of Judge Batts. Eugenia then asked the three-judge panel to reconsider their verdict and they declined to do so. Eugenia also requested a full “en banc” appellate review by all of the judges on the United States Second Circuit Court of Appeals, and they too affirmed the verdict and dismissal; thereby, confirming the judgment in favor of Mr. Glaser and all other MapleWood-associated defendants.

Eugenia/Casita filed a lawsuit in June 2011. The defendants won the case on summary judgment, on September 30, 2015. However, the summary judgment was set aside on appeal and the case is still pending.

Eugenia/Casita filed a lawsuit in 2005. This lawsuit was stayed as a result of Eugenia/Casita filing an involuntary bankruptcy petition related to the defendant entities.

In addition to the 18 lawsuits filed by Eugenia/Casita, 2 other lawsuits were filed against Mr. Glaser and/or entities and other people associated with the MapleWood Funds. Both of these 2 lawsuits were filed by parties involved in the Casita/Eugenia litigation described above. Both of these 2 lawsuits have been resolved and, again, Mr. Glaser, MapleWood, and its affiliates and employees were not found liable for any misconduct. And, Mr. Glaser, MapleWood and its affiliates and employees were not ordered by either of these courts to pay any damages, compensation, and/or restitution, to the Plaintiffs, or any other person or entity.

In May 2005 a lawsuit was filed in the Supreme Court of the State of New York, County of Nassau. This lawsuit was dismissed by the Court, with prejudice.

In January 2012 a lawsuit was filed in the Supreme Court of the State of New York, County of Nassau. This lawsuit was voluntarily dismissed.
